[25-009] Incident Logs & Employee Identification

Post by Miguel Espinal »

To whom it may concern,

This letter serves as a formal request pursuant to the San Andreas Freedom of Information Act, as codified under state law.

On February 8, 2025, the Los Santos Sheriff's Department was called to the Valentines Rehab Center. During this event, a female Sergeant within the Traffic Services Division was called and arrived on scene to manage the incident. Pursuant to the San Andreas Freedom of Information Act, please provide:

1. The identity of the Sergeant from the Traffic Services Detail that responded to the scene after a call was placed to the Sheriff's Department Non-Emergency phone number.

2. Any reports, documents or logs pertaining to this event.

I request that the department comply with the requirements of SAFOIA, including but not limited to:
- Responding to this request within 14 business days of receipt, as stipulated under Section IV(c) of SAFOIA.
- Providing a written explanation, as required under Section IV(f), if any requested materials are deemed exempt or unavailable.

Failure to respond adequately within the statutory timeframe may compel our firm to seek judicial intervention to enforce compliance with the SAFOIA provisions.

If there are any fees associated with processing this request, please provide a detailed estimate before fulfilling it. However, I urge the department to consider waiving fees in the interest of public accountability and transparency.

Information is not pre-compiled; it's not in readily available databases or reports, which is an FOIA exemption.
(11) Requests that may take an unreasonable amount of time to complete, including but not limited to, statistics, analytics, reports and information that is not already pre-compiled by the agency.
(12) Requests that heavily constrain agency resources just to compile or complete in achievement of a request presented under this act.
However, you are requesting the identity of the Traffic Services Detail Sergeant who handled this incident on February 5th? For what purpose.

Commander Turner,

Without going into too much detail, my firm is looking into filing a suit against a party for fraud. The Sergeant in question responded to an incident this person was party to, and as such, we intend to identify and then call the Sergeant as a witness.
