If you are interested in being on parole for a long period of time, fill in the format below and a member of the faction will handle it accordingly. The process is as follows:

Note:
  • Your character needs to be on good behavior (no segregation, write-ups, etc in recent history).
    Your character needs to show remorse for their charges. Parole is a rehabilitative process. Even if they're faking it.

Lifer Parole Process

This is strictly informational.

As of right now we're not going to introduce a fully fledged lifer parole process which works in tandem with our current one for functionality and efficiency reasons, but we feel it's important that portrayal is done accurately. Most of the characters requesting parole out of this section will be lifers. Thus this is how the lifer parole process works in real life, and you can tailor your role-play surrounding it as you wish.

The current system allows us to impose special conditions on a case by case basis and that's what we're going to go ahead with. You can request those for your character.
Parole Hearings
There are two general classes of inmates in our California prison system. Inmates sentenced to determinate sentences, such as a term of seven years, serve a finite period of time that has been set by the criminal court and, upon expiration of the sentence, they are released. Inmates sentenced to an indeterminate term, such as life with the possibility of parole, are released only after it is determined that he or she is not a current, unreasonable risk of danger to the public. The Board of Parole Hearings conducts life prisoner suitability hearings to determine whether these inmates are suitable for parole.

Inmates serving life sentences become eligible for parole hearings by statute one year prior to their minimum eligible parole date (MEPD). At the hearing, the panel considers all relevant and reliable information in the individual case in order to determine whether the inmate is suitable for release. If an inmate is found unsuitable for parole, statutory law requires that the next hearing be set 3, 5, 7, 10, or 15 years in the future. An inmate who is denied parole may request that his or her hearing be moved to an earlier date, based on a change of circumstances or new information that establishes a reasonable likelihood that consideration of public safety does not require the additional period of incarceration imposed by the denial length that was issued.

Suitability Criteria
Parole suitability hearings are held to determine if an inmate currently poses an unreasonable risk of danger to society if released from prison. The panel will consider “all relevant, reliable information available to the panel” in determining the inmate’s suitability for parole. (Cal. Code Regs., tit. 15, § 2281.)

California Code of Regulations, title 15, section 2281 provides a number of factors tending to show both suitability and unsuitability for parole. These factors are general guidelines and “the importance attached to any circumstance or combination of circumstances in a particular case is left to the judgment of the panel.” (Cal. Code Regs., tit. 15. § 2281, subd. (d).) Factors tending to show an inmate’s suitability include: (1) lack of a juvenile record, (2) stable social history, (3) signs of remorse, (4) motivation for the crime, (5) lack of criminal history, (6) age, (7) understanding and plans for the future, and (8) institutional behavior. (Cal. Code Regs., tit. 15. § 2281, subd. (d)(1)-(9).). The panel will also consider whether the inmate suffered from Battered Woman Syndrome or Intimate Partner Battering at the time of the crime and whether the crime resulted from the inmate’s victimization. (Pen. Code § 4801.) After the panel weighs the evidence, they will consider evidence suggesting unsuitability. The factors of unsuitability include the inmate’s (1) commitment offense, (2) previous record of violence, (3) unstable social history, (4) prior sadistic sexual offenses, (5) psychological factors, including the prisoner’s history of mental problems related to the crime, and (6) institutional misconduct in prison or jail. (Cal. Code Regs., tit. 15. § 2281, subd. (c)(1)-(6).). Additionally, the California Supreme Court has held that an inmate’s lack of insight is a significant factor in determining whether the inmate is currently unsuitable. (In re Shaputis II (2011) 53 Cal.4th 192.)

While the California Supreme Court has found that the Board’s “discretion in parole matters has been described as ‘great’ and ‘almost unlimited’,” if the panel finds the inmate unsuitable for parole, the panel must articulate their decision with evidence supporting their findings. (In re Rosencrantz (2002) 29 Cal.4th 616.) In finding an inmate unsuitable for parole based upon static factors such as the crime or the inmate’s criminal history, the panel must support their decision by showing “some evidence” that “those facts support the ultimate conclusion that an inmate continues to pose an unreasonable risk to public safety.” (In re Lawrence (2008) 44 Cal.4th 1181.) Upon finding that an inmate does not pose an unreasonable risk to society and is therefore suitable for parole, the panel will set a release date in accordance with guidelines set forth in Penal Code section 3041.

Who Participates in the Hearing?
The hearings are conducted by a Commissioner, who is appointed by the Governor and subject to Senate Rules Committee confirmation, and a Deputy Commissioner, who is a civil servant employee of the state. Inmates are entitled to legal counsel at their hearings. The District Attorney from the prosecuting county may ask clarifying questions and render a statement on the question of parole suitability. The victims of the crime and/or their representatives may attend the hearing and address the panel with their comments on suitability and/or the impact of the crime.

Public Comment
Any person may submit information to the Board of Parole Hearings concerning any inmate or parolee. Written comments should be directed to the Classification and Parole Representative at the prison where the hearing will be conducted. Those comments will be included in the inmate’s or parolee’s Central File and will be considered by future hearing panels.

What Happens to a Parole Decision?
Once a decision is final, generally after the 120-day decision review period, the Governor has statutory authority under Penal Code sections 3041.1 and 3041.2 to review parole suitability decisions. Up to 90 days prior to a scheduled release date of an inmate, the Governor may request that the Board review its panel’s decision. When such a request is made, the matter is placed on the Board’s public meeting agenda and the public has the opportunity to give a 5-minute statement on whether the Board’s hearing decision should be upheld. If an inmate was convicted of murder, the Governor may reverse or modify the Board’s decision without referring it back to the Board for review.

VOLUNTARY PAROLE INFORMATION

——PAROLE

——— All inmates released from a San Andreas State jail who are subject to a period of parole supervision will have conditions of parole that must be followed. Some parolees will have imposed special conditions of parole which must also be followed. Special conditions of parole are related to the commitment offense and/or criminal history and will discourage criminal behavior, improving the parolee’s chances for success on parole. Based on each inmate's jacket, individuals qualify for one of the tree tiers of parole supervision: heavily supervised, lightly supervised, unsupervised.

General Conditions of Parole refer to the totality of written rules to which a prospective parolee will be subject to whilst being on parole supervision, and all of them are compulsory. A Notice and Conditions of Parole will give the date that and inmate is released from prison and the maximum length of time they may be on parole.

Special Conditions of Parole refer to special rules imposed in addition to the general conditions of parole and must also be followed. They are related to an inmate's committed offense and/or criminal history, and may be imposed by the Los Santos County Sheriff's Department executives or the court.

——GENERAL CONDITIONS

A parolee, their residence (where they live or stay) and their possessions can be searched at any time of the day or night, with or without a warrant, and with or without a reason, by any parole officer.
A parolee must always give their parole officer the address where they live and work.
A parolee must give their parole officer their new address before they move.
A parolee must notify their parole officer within three days if the location of their job changes, or if they get a new job.
A parolee must report to their parole officer whenever they are told to do so.
A parolee must follow all of their parole officer’s verbal and written instructions.
A parolee is conditioned to obey all applicable state laws.
A parolee must immediately seek to inform their parole agent if they are detained or otherwise arrested and specify they are on parole at the time of the incident. The same applies for citations.
A parolee is strictly prohibited from owning or having access to any kind of weapons as defined by the San Andreas Penal Code in their immediate surroundings (whereas this is applicable to firearms, blades, et-cetera). Kitchen knives must be kept in the kitchen. Knives one may use for work are allowed only when approved by their parole agent but they can only be carried while they are at work. This includes anything that looks like a real weapon as well.

——SPECIAL CONDITIONS

As special conditions are related to an inmate's committed offense and/or criminal history, these are discussed internally during the parole review stage of an applicant and are communicated on a case by case basis, where applicable. If there is no mention of special conditions upon a parolee's effective release date (or prior to), special conditions do not apply.

——STATUTORY PAROLE REQUIREMENTS

All parolee’s are subject to additional statutory requirements as a condition to their release from incarceration. These requirements include, but are not limited to; defined placement as to where they may legally reside; an implied consent to be searched with or without a warrant and with or without cause; and, if applicable, special conditions of parole as outlined above.

Any inmate who is eligible for release on parole pursuant to this chapter shall agree in writing to be subject to search or seizure by a peace officer at any time of the day or night, with or without a search warrant and with or without cause.

An inmate who is released on parole shall be returned to the county that was the last legal residence of the inmate prior to his or her incarceration. For purposes of this subdivision, “last legal residence” shall not be construed to mean the county wherein the inmate committed an offense while confined in a state prison or local jail facility or while confined for treatment in a state hospital.

San Andreas Street Terrorism Enforcement & Prevention Act of 2019 – Gang Registration — Any person described in section 101-2 of the STEPA Act ("<gang member>" and all variations are referencing any person who actively participates in any criminal street gang with knowledge that its members engage in, or have engaged in, a pattern of criminal activity, and who willfully promotes, furthers, or assists in any criminal conduct by members of that gang.") in this section shall register with the LSSD Parole Operations Bureau prior to their effective release date. The STEPA Act has many subsections that affect gang registration and should be reviewed in its entirety for complete information.

Parole Officers may issue lawful verbal instructions which a parolee must adhere to. Examples of these instructions include, but are not limited to:

  • Instructions to report to the parole office on a particular date and time.
    Instructions to submit to anti-narcotic testing.
    Instructions to register with local law enforcement.

Players who are involved with other factions (both legal and illegal) on separate characters are required to submit a form to request permission to join more than one faction at the same time. The primary reason for this is to ensure that activity is separated out evenly between the factions and for our reference should any conflicts in roleplay or activity arise. Double faction permission is required for all positions, civilian and sworn and permission must be obtained from the other faction as well. There are several limitations surrounding double faction permission:
  • Players must ensure that they are able to maintain the activity standard required of their position within the faction and are beholden to the same activity requirements as all other faction members.
  • Players with double faction permission between the LSSD and a criminal faction must avoid extensive roleplay with their specific criminal faction which includes investigation, excessive corruption, favors, etc.
  • Double faction permission must be obtained BEFORE submitting any sort of application (recruitment, reinstatement, transfer, etc). Failure to do so will result in denial.

    EXPERIENCE
    Candidates must be employed as full-time peace officers in a San Andreas Commission on Peace Officer Standards and Training (P.O.S.T.) certified law enforcement agency with two years of continuous peace officer experience at the time of filing.

    Full-time experience is defined as a 40-hour work week. Continuous experience is defined as full-time experience gained within two years from date of application.

    CERTIFICATE
    Candidates must possess a P.O.S.T. Basic, Intermediate, or Advanced certificate(s) at the time of filing.

    Candidates must be in good general physical fitness and free from any medical conditions that would interfere with the satisfactory performance of the position of Deputy Sheriff Trainee.

    LATERAL TRANSFER APPLICATION
    The first phase of the Los Santos Sheriff's Department's Lateral Transfer Process is the Application for Lateral Transfer. This application is sent to Personnel Administration and starts the competitive lateral entry process.

    (( Initiating the process does not guarantee any offer of invitation. As each transfer opening inherently seeks to fill slots, it will be a competitive process. People interested in joining the Sheriff's Department may better be served by entering through our recruitment process unless they feel they have something to offer the faction.

    Each step is conducted exclusively through private messaging. Only Executive Staff, Command Staff, and individuals informed by the candidate are made aware of their intention to transfer. It is strongly advised that the candidate informs their faction leadership of their intent to transfer prior to initiating the transfer process, as an unexpected resignation may lead to frustration and potential conflict. It is important to note that our faction is unable to address any issues the candidate may have in their current faction.

    SUPPLEMENTAL QUESTIONNAIRE
    After a preliminary records check into a candidate's employment history as a law enforcement officer, the applicant is evaluated based upon their fitness for the position of a Los Santos County Sheriff's Deputy. Due to the competitiveness of this process, applicants with solid employment histories and work ethics will only be considered.

    (( This phase includes a rigorous OOC mindset test used to establish a player's motive in joining the faction and their mannerisms/style of roleplay. As our faction's goal is to provide an environment conducive to good roleplay for all players, players who have the wrong mindset will be weeded out through this questionnaire. This questionnaire is in fact the same one as for recruits. Based upon the answers to this test, a candidate is either deferred or inducted. Candidates who are deferred are welcome to try again next time there are vacancies. ))

    CONDITIONAL OFFER
    After supplementary questions have been answered to a satisfactory degree, the candidate is offered conditional employment contingent upon a psychological and medical check.

    (( Please note that there are never any guaranteed "equivalencies" between ranks for transfers, and there is no established pattern for transferring in from a high rank. It is obviously impossible for a Police Officer II to be offered any position outside of Deputy Sheriff. Outside of special circumstances (such as important vacancies or manpower shortages), it is unlikely you will be offered any position outside of Deputy Sheriff in general. ))
